License Agreement

The short version. ByteBack Live is a free app on Google Play that plays the live wallpapers you buy on bytebacknj.com. You can use it on your own devices. Don't share the wallpaper packs you bought, and don't pick the app apart beyond what the law allows. It comes as is. All wallpaper sales are final, as explained in Refunds and terms of sale.

Agreement

This End-User License Agreement ("Agreement") is between you and ByteBack ("ByteBack", "we", "us", "our"). It covers the ByteBack Live Android app (package com.byteback.live), including its live-wallpaper service, its home-screen and lock-screen widget, and its pack library (together, "the app"). By installing or using the app, you agree to this Agreement. If you don't agree, don't install the app, or uninstall it.

The app is distributed free of charge through Google Play. The app itself contains no purchases, prices or purchase links. Wallpaper packs are sold separately on bytebacknj.com and can then be imported into the app and activated with a license key.

Google Play

Because you get the app from Google Play, the Google Play Terms of Service and Google's other applicable policies also apply to your download and use of the app. If they conflict with this Agreement on how Google Play works, Google's terms control for that matter.

This Agreement is between you and ByteBack only, not Google. Google LLC and its affiliates are not responsible for the app or its content, have no obligation to provide maintenance or support for it, and are not responsible for any claims relating to it. ByteBack, not Google, is solely responsible for the app, subject to this Agreement.

License grant

ByteBack grants you a personal, non-exclusive, non-transferable, revocable, royalty-free license to install and use the app on Android devices that you own or control, for your own personal, non-commercial use, subject to this Agreement and to the Google Play terms.

The app itself is free. Wallpaper packs that you buy are licensed separately under the Wallpaper License included with each purchase (LICENSE.txt). If this Agreement and a Wallpaper License conflict about a pack, the Wallpaper License controls for that pack.

Restrictions

You agree NOT to:

License keys and activation

Wallpaper packs bought on bytebacknj.com come with a license key issued by Lemon Squeezy, which sells ByteBack products as merchant of record. When you enter a key, the app contacts Lemon Squeezy to activate it, as described in the ByteBack Live Privacy Policy. A license key may have a limit on how many installs it can be activated on. Activation needs an internet connection; once a pack is imported, it plays without one.

Ownership

The app, its code, its design, the ByteBack Live name and all wallpaper content are owned by ByteBack or its licensors and are protected by copyright and other laws. This Agreement gives you a license to use them, not ownership of them. All rights not expressly granted are reserved. Open-source components included in the app are licensed under their own terms, listed in the third-party notices for the app.

Wallpaper purchases and refunds

Wallpaper packs are not sold in the app or through Google Play. They are sold on bytebacknj.com and processed by Lemon Squeezy as merchant of record, and Lemon Squeezy's buyer terms apply to those purchases. Our Refunds and terms of sale page applies: digital downloads are final once the order is complete. If a download fails, or a pack won't import or play on a supported device, message us with your order number and we'll fix the problem or send a working copy. Duplicate or unauthorized charges will be returned. Google is not involved in, and not responsible for, these purchases. Nothing in this Agreement limits any rights you have under the consumer laws where you live.

Updates

Updates to the app are delivered through Google Play, according to your Google Play and device update settings. This Agreement applies to updates unless an update comes with different terms. We may change or remove app features, and we may stop offering the app, but packs you have already imported stay on your device.

Disclaimer of warranty

The app and all wallpaper content are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that it will work on every device or Android version, or that it will not affect battery life or device performance. Some jurisdictions don't allow the exclusion of implied warranties, so some of the above may not apply to you.

Limitation of liability

To the maximum extent permitted by law, ByteBack is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to the app or this Agreement, even if advised of the possibility of such damages. ByteBack's total liability for any claim arising out of or related to the app or this Agreement is limited to the amount you paid for ByteBack Live wallpaper packs in the twelve months before the claim, or US $10 if you paid nothing. Some jurisdictions don't allow these limitations, so some of the above may not apply to you.

Termination

This Agreement lasts until it ends. You can end it at any time by uninstalling the app and deleting any copies. It ends automatically, without notice, if you break any term of it. When it ends, you must stop using the app and delete it. The Google Play, Restrictions, Ownership, Disclaimer of warranty, Limitation of liability, Governing law and General sections survive termination. Termination does not entitle you to a refund, except where the law requires one.

Governing law

This Agreement is governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in New Jersey, and you consent to that jurisdiction and venue, except where the consumer laws of your place of residence give you the right to bring a claim locally.

General

If any part of this Agreement is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of it. You may not assign this Agreement; we may assign it in connection with a sale or transfer of the app. This Agreement, the Privacy Policy and any Wallpaper License for packs you buy are the entire agreement between you and ByteBack about the app.

Changes

We may update this Agreement. If we make material changes, we'll update the "Last updated" date and post the new version here before it takes effect. Continued use after a change means you accept the updated Agreement.
